In
the court room, and in the law firm, where both sides have
all facts and all legal citations, the case will be won, or lost, on rhetoric;
on legal rhetoric; on the appreciation of legal principles, presumptions,
doctrines, rules, tests, maxims, and phrases. To the legal writer, a mention of
a doctrine here, a maxim there, and a test in the conclusion, will flower the
article, making it to sound well researched, more persuasive and ultimately
effective. To the legal speaker, the solicitor, legal rhetoric arrests
attention, holds conscience captive and wins the will of the adjudicator. Legal Rhetoric!
